Terms and Conditions

Last updated: 18 August 2026

These Terms and Conditions ("Terms") govern your access to and use of the Native Nature website, available at https://thenativenature.com/, the Native Nature mobile applications available for Android and iOS, and any related services, features, subscriptions, products, ordering systems, or digital services provided by us (collectively, the "Service").

The Service is owned and operated by Pitvas Naturals Private Limited, trading under the brand name Native Nature, with its business address at Bhasleta Road, Brahamashtani, Fatehpur, Patna, Bihar 800007, India ("Company", "Native Nature", "we", "us", or "our").

Please read these Terms carefully before using our Website or Applications or placing an order. By accessing the Service, creating an account, purchasing a product, starting a subscription, or otherwise using the Service, you agree to be bound by these Terms.

If you do not agree with these Terms, you should not access or use the Service.

1. Definitions

For the purposes of these Terms:

  • "Application" or "App" means the Native Nature mobile application made available for Android, iOS, or another supported device or platform.
  • "Company" means Pitvas Naturals Private Limited, trading as Native Nature.
  • "Customer", "User", "you", or "your" means any individual accessing, browsing, registering with, ordering from, or otherwise using the Service.
  • "Goods" or "Products" means dairy products and other products offered by Native Nature, including A2 Gir cow milk, ghee, and any other products that we may offer from time to time.
  • "Order" means a request made by you to purchase Goods from Native Nature.
  • "Subscription" means any recurring delivery, recurring order, membership, or similar arrangement offered through the Service.
  • "Service" collectively means the Website, Applications, ordering system, subscriptions, and other related services operated by Native Nature.
  • "Website" means https://thenativenature.com/.

2. Eligibility and Age Requirement

You must be at least 18 years of age and legally capable of entering into a binding contract under applicable Indian law to create an account, place an Order, start a Subscription, or otherwise transact through the Service.

By using the Service, you represent and warrant that you meet this eligibility requirement.

If a Product is intended for a child or another person under the age of 18, the Order must be placed and managed by an eligible adult, parent, or legal guardian.

We reserve the right to refuse access to, suspend, or terminate an account where we reasonably believe that the eligibility requirements have not been satisfied.

3. Account Registration

Certain features of the Service may require you to create an account. When creating or using an account, you agree to provide information that is accurate, current, and complete.

You are responsible for:

  • Maintaining the confidentiality of your account credentials;
  • Keeping your account information up to date;
  • Restricting unauthorised access to your device and account;
  • All activities conducted through your account, to the extent permitted by law; and
  • Informing us promptly if you suspect unauthorised access to or use of your account.

You must not impersonate another person, register using false information, or use another person's account without their permission.

We may suspend or terminate accounts that contain false information, are being misused, violate these Terms, or present a security or fraud risk.

4. Products and Product Information

Native Nature sells dairy products, including fresh milk and ghee, as well as any additional products that may be displayed on the Website or Applications from time to time.

We endeavour to ensure that product descriptions, photographs, quantities, prices, availability, and other information displayed through the Service are accurate. However, minor variations may occur.

Because some Native Nature products are agricultural, natural, handmade, fresh, or small-batch products, there may be reasonable variations in characteristics such as colour, consistency, aroma, texture, appearance, or packaging between batches.

Such natural variations do not necessarily mean that a Product is defective or unsuitable for consumption.

Product photographs are provided for general illustration. Packaging, labels, containers, presentation, and appearance may change from time to time without materially changing the Product.

5. Availability of Products

All Products and Orders are subject to availability.

Fresh dairy production can be affected by factors including production volumes, seasonal conditions, animal health and welfare, delivery capacity, weather, supply conditions, and circumstances beyond our reasonable control.

We therefore reserve the right to limit quantities, temporarily suspend the availability of a Product, change delivery availability, or cancel an Order where fulfilment is not reasonably possible.

If we cancel a prepaid Order because we cannot supply it, we will arrange an appropriate refund for the cancelled portion of the Order in accordance with applicable law and our policies.

6. Placing an Order

By placing an Order through the Website, Application, or another ordering channel authorised by Native Nature, you are offering to purchase the selected Products subject to these Terms.

You are responsible for reviewing your Order before submitting it, including the Product, quantity, delivery address, telephone number, delivery instructions, billing information, and applicable Subscription details.

Receiving an automated order acknowledgement or payment confirmation does not necessarily mean that an Order has been accepted for fulfilment.

We may reject or cancel an Order where reasonably necessary, including where:

  • A Product is unavailable;
  • The delivery address is outside our serviceable area;
  • There is an obvious pricing or listing error;
  • Payment has not been successfully completed;
  • We reasonably suspect fraud, misuse, or unauthorised payment;
  • The requested quantity cannot reasonably be fulfilled;
  • The Order violates these Terms or applicable law; or
  • Events outside our reasonable control prevent fulfilment.

7. Prices

Product prices will be displayed on the Website, Application, checkout page, Subscription screen, or other applicable ordering interface.

Prices may be changed from time to time. Unless otherwise stated, a price change will not retroactively affect an Order that has already been accepted and paid for.

Applicable taxes, delivery charges, handling charges, or other charges, where applicable, may be displayed separately during checkout or included in the displayed price depending on the nature of the Product and transaction.

In the event of an obvious pricing or technical error, we reserve the right, subject to applicable law, to cancel or correct the affected Order rather than supply a Product at an obviously erroneous price.

8. Payments

We may accept payments through payment gateways, UPI, cards, net banking, digital wallets, cash on delivery where available, or other payment methods displayed through the Service.

Some payment transactions are processed by independent third-party payment processors. Your use of those payment methods may also be governed by the payment provider's terms, conditions, privacy practices, fraud controls, and processing requirements.

Native Nature does not guarantee that every payment method will always remain available.

You agree to provide valid and authorised payment information and confirm that you are authorised to use the payment method selected for an Order.

We may delay or cancel fulfilment if a payment is declined, reversed, disputed, flagged for review, or not successfully received.

9. Subscriptions and Recurring Orders

Native Nature may offer recurring deliveries or Subscriptions for certain Products, including milk or other regularly delivered products.

The specific price, quantity, delivery frequency, billing frequency, duration, and other Subscription details will be displayed when you select or purchase the applicable Subscription.

Where a Subscription uses recurring automatic payments, you authorise Native Nature and its authorised payment provider to charge the applicable Subscription amount using your selected payment method in accordance with the billing cycle disclosed when you subscribe.

Your Subscription may continue until cancelled unless a fixed duration or another arrangement is specifically stated when you subscribe.

Subscription Price Changes

We may change Subscription pricing where reasonably necessary, including because of changes in production costs, sourcing, packaging, delivery expenses, taxes, or business conditions.

Where required, we will provide reasonable notice of a material price change before it applies to a future billing cycle.

Pausing or Cancelling a Subscription

Where the feature is available, you may request to pause, modify, or cancel a Subscription through your account or by contacting Native Nature.

A cancellation request should be submitted before the next Order has been processed, prepared, dispatched, or delivered.

Once a fresh or perishable Product has already been prepared, processed, dispatched, or delivered, cancellation and refund eligibility may be limited in accordance with our Refund and Returns Policy and applicable law.

10. Delivery

Delivery availability depends on the serviceable locations displayed or communicated by Native Nature. We currently serve locations based on our available delivery network and may expand, restrict, modify, or temporarily suspend service areas.

Any delivery date or time communicated through the Service is an estimate unless expressly stated otherwise.

Delivery times may be affected by traffic, weather, operational issues, order volumes, vehicle issues, public restrictions, local conditions, or circumstances beyond our reasonable control.

You are responsible for providing a complete and accurate delivery address, telephone number, and any information reasonably necessary to complete delivery.

If delivery cannot be completed because the address or contact information supplied by you is incorrect, incomplete, inaccessible, or because no suitable person is available to accept a time-sensitive delivery, refund or redelivery eligibility may be limited, particularly for fresh or perishable Products.

11. Fresh and Perishable Products

Certain Native Nature Products, particularly fresh milk and other fresh dairy Products, are perishable and require appropriate handling and storage.

You agree to follow storage, refrigeration, use-by, handling, preparation, and consumption instructions appearing on the Product, packaging, Website, Application, or otherwise supplied by Native Nature.

Once a fresh Product has been delivered, you are responsible for storing and handling it appropriately.

We cannot be responsible for deterioration caused after delivery by improper storage, exposure to unsuitable temperatures, contamination after opening, failure to refrigerate, failure to follow instructions, or other improper handling by the Customer.

Nothing in this section limits any rights available to you under applicable consumer protection law for Products that were defective, unsafe, damaged, spoiled, incorrectly supplied, or otherwise legally non-conforming at the time of delivery.

12. Inspection of Products

We recommend inspecting delivered Products as soon as reasonably possible after receiving them.

If you believe a Product is damaged, leaking, incorrectly supplied, spoiled at the time of delivery, or otherwise defective, please contact us promptly through our Contact page.

We may reasonably request information such as your Order number, photographs, packaging details, delivery information, or a description of the issue so that we can investigate your request.

13. Order Cancellations, Returns and Refunds

Cancellations, returns, exchanges, and refunds are governed by our Refund and Returns Policy, which forms part of these Terms.

Because Native Nature sells fresh and perishable dairy Products, not every Product can be returned after delivery.

In particular, Products that deteriorate rapidly, are perishable by nature, have expired, or cannot safely be returned for health or hygiene reasons may be excluded from ordinary returns to the extent permitted by applicable law.

This does not affect your statutory rights where a Product is defective, damaged, unsafe, incorrectly supplied, or otherwise required to be refunded or replaced under applicable Indian law.

Please review the Refund and Returns Policy before placing your Order.

14. Offers, Discounts and Promotional Codes

Native Nature may offer promotional discounts, coupons, referral benefits, introductory offers, free-delivery promotions, Subscription discounts, or other promotional benefits from time to time.

Promotions may be subject to separate eligibility criteria, validity periods, minimum Order requirements, location restrictions, Product exclusions, usage limits, or other terms.

Unless expressly permitted, promotional codes cannot be combined, exchanged for cash, transferred, sold, or applied retrospectively.

We may withdraw, suspend, or modify a promotion in accordance with its applicable conditions and applicable law.

We may reject use of a promotional benefit where we reasonably determine that it has been obtained or used fraudulently, abusively, or contrary to the applicable promotional terms.

15. Food, Dietary and Health Information

Information provided through the Service about milk, ghee, dairy, nutrition, traditional practices, farming, ingredients, A2 milk, or other topics is provided for general informational purposes.

Unless expressly stated otherwise, information on the Service is not intended to constitute medical advice, diagnosis, treatment, or a substitute for professional healthcare advice.

Individual dietary requirements, allergies, intolerances, health conditions, and responses to food products vary.

If you have a milk allergy, dairy intolerance, medical condition, dietary restriction, or concerns about whether a Product is suitable for you or a family member, you should obtain appropriate advice from a qualified healthcare professional before consumption.

You should not disregard professional medical advice or delay seeking medical care because of information provided through Native Nature.

16. Acceptable Use of the Service

You agree not to use the Website, Applications, or Service to:

  • Violate any applicable law or regulation;
  • Commit or facilitate fraud;
  • Provide intentionally false account, delivery, or payment information;
  • Impersonate another individual or organisation;
  • Attempt unauthorised access to accounts, servers, databases, or systems;
  • Introduce malware, viruses, malicious code, or harmful technology;
  • Interfere with the security, availability, or operation of the Service;
  • Scrape, crawl, harvest, or extract data through unauthorised automated means;
  • Circumvent security or technological restrictions;
  • Abuse promotional, referral, Subscription, refund, or payment systems;
  • Make fraudulent chargebacks or payment disputes;
  • Copy or commercially exploit our content without permission;
  • Reverse engineer the Application except where applicable law expressly permits it;
  • Use the Service in a way that infringes another person's intellectual property or legal rights; or
  • Engage in activity that could harm Native Nature, its customers, employees, partners, or infrastructure.

17. User-Generated Content

Native Nature does not currently provide users with a general right to publicly upload or publish their own content through the Service.

If we introduce reviews, ratings, photographs, comments, testimonials, or similar features in the future, additional rules may apply to those features.

Nothing in these Terms requires Native Nature to host, publish, or continue displaying customer-submitted material.

18. Intellectual Property Rights

Unless otherwise indicated, the Service and its original content, design, branding, layout, photographs, graphics, illustrations, product descriptions, text, software, functionality, databases, logos, trademarks, icons, videos, and other materials are owned by or licensed to Pitvas Naturals Private Limited and are protected by applicable intellectual property laws.

Native Nature, its logos, branding, product names, trade dress, and associated marks may not be used without prior written permission where such permission is legally required.

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable right to access and use the Service for lawful personal purposes.

You may not, without our prior written permission:

  • Republish substantial portions of our Website or Application;
  • Reproduce our copyrighted materials for commercial purposes;
  • Sell, sublicense, or commercially exploit our digital content;
  • Use our branding in a way that falsely implies endorsement or affiliation;
  • Create confusingly similar branding or digital services; or
  • Remove copyright, trademark, or proprietary notices.

19. Mobile Applications

These Terms apply to Native Nature's Android and iOS Applications in addition to the Website.

You are responsible for obtaining and maintaining a compatible device, operating system, internet connection, mobile data service, and other equipment necessary to use the Application.

Application functionality may differ depending on your device, operating system, Application version, location, permissions, or technical environment.

We may release updates, modifications, security fixes, or new versions of the Application. Certain functionality may require you to install an updated version.

Your downloading and use of an Application may also be subject to applicable terms and policies of the app store or platform through which the Application is distributed.

20. Application Permissions

Some Application features may request access to certain device functions or information where reasonably necessary to provide the requested functionality.

Any collection and processing of personal information through such permissions will be governed by our Privacy Policy and applicable law.

Depending on your device and operating system, you may be able to manage Application permissions through your device settings. Disabling a necessary permission may prevent some features from functioning correctly.

21. Third-Party Services

The Service may rely on or integrate with third-party services, including payment processors, payment gateways, delivery or logistics providers, cloud hosting providers, communication providers, analytics services, mapping services, authentication services, app stores, and other technology providers.

These independent services may have their own terms of service and privacy policies.

Where you interact directly with a third-party service, your relationship with that provider may also be governed by the provider's applicable terms.

Native Nature is not responsible for the independent acts, omissions, terms, policies, or systems of third-party providers except to the extent responsibility cannot legally be excluded.

22. External Links

The Website or Applications may contain links to third-party websites, social-media platforms, payment services, maps, messaging services, or other external resources.

A link does not necessarily mean that Native Nature endorses or controls the third-party website, service, content, or provider.

We are not responsible for external websites or services that we do not own or control. You should review their applicable terms and privacy policies before using them.

23. Privacy and Personal Data

Your privacy is important to us. Our collection, use, storage, disclosure, and processing of personal information is described in our Privacy Policy.

By using the Service, you acknowledge that personal information may be processed as necessary to operate the Service, manage accounts, process Orders and Subscriptions, complete payments, arrange deliveries, provide customer support, maintain security, comply with legal obligations, and perform other activities described in our Privacy Policy.

Please read the Privacy Policy together with these Terms.

24. Communications

By creating an account, placing an Order, starting a Subscription, or contacting us, you understand that we may send you transactional or service-related communications where reasonably necessary.

These communications may include:

  • Order confirmations;
  • Payment confirmations;
  • Delivery updates;
  • Subscription reminders or updates;
  • Account or security notices;
  • Customer-support responses;
  • Product availability notifications relating to an Order; and
  • Important changes affecting the Service.

Marketing or promotional communications will be handled in accordance with applicable law, your preferences, and our Privacy Policy.

25. Service Availability

We aim to keep the Website and Applications available and functioning properly, but we do not guarantee uninterrupted, error-free, or continuously available access.

The Service may occasionally be unavailable because of maintenance, updates, technical failures, internet interruptions, security measures, third-party failures, or circumstances outside our reasonable control.

We may modify, update, suspend, discontinue, or replace features of the Service where reasonably necessary, subject to applicable law and any obligations relating to existing paid Orders or Subscriptions.

26. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Website, Applications, and associated digital services are provided on an "as available" basis.

While we take reasonable steps to provide accurate information and reliable services, we do not warrant that:

  • The Service will always be uninterrupted or error-free;
  • Every feature will be available on every device or in every location;
  • All non-material errors on the Website or Application will immediately be corrected;
  • Third-party services will remain continuously available; or
  • The Service will meet every individual user's particular expectations.

Nothing in these Terms excludes warranties, guarantees, statutory rights, or remedies that cannot lawfully be excluded under applicable Indian law.

27. Limitation of Liability

To the maximum extent permitted by applicable law, Pitvas Naturals Private Limited, its directors, officers, employees, representatives, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of, or inability to use, the Service where such liability may lawfully be excluded.

This includes, where permitted by law, losses caused by unauthorised use resulting from a user's failure to secure account credentials, third-party system interruptions, or misuse of the Service contrary to these Terms.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including applicable consumer protection rights.

28. Customer Responsibility

You are responsible for:

  • Using the Service lawfully and in accordance with these Terms;
  • Providing accurate account and Order information;
  • Providing a valid and serviceable delivery address;
  • Being available to receive time-sensitive deliveries where required;
  • Properly storing and handling Products after delivery;
  • Following Product labels and storage instructions;
  • Reviewing ingredients and suitability where you have dietary concerns;
  • Maintaining the security of your account and devices; and
  • Paying all valid amounts due for Orders or Subscriptions placed by you.

29. Fraud and Abuse

We reserve the right to investigate activity that we reasonably suspect involves fraud, payment abuse, repeated false refund requests, promotional abuse, account manipulation, unauthorised payment methods, or other misuse.

Where reasonably necessary and permitted by law, we may reject an Order, restrict an account, suspend promotional benefits, cancel a Subscription, or terminate access to the Service.

Serious suspected unlawful activity may be reported to payment providers, regulators, law-enforcement authorities, or other appropriate organisations where legally permitted or required.

30. Suspension and Termination

We may suspend or terminate your account or access to some or all of the Service if you materially violate these Terms, engage in fraudulent or unlawful activity, create a security risk, or repeatedly misuse the Service.

Where appropriate, we may provide notice or an opportunity to resolve the issue before termination. Immediate action may be taken where reasonably necessary for security, fraud-prevention, legal, or safety reasons.

Termination does not automatically extinguish rights, liabilities, payment obligations, or claims that arose before termination.

31. Force Majeure

Native Nature will not be responsible for delays or failures caused by events beyond our reasonable control, to the extent permitted by applicable law.

Such events may include:

  • Floods, storms, extreme weather, earthquakes, or natural disasters;
  • Fire or major accidents;
  • Epidemics, pandemics, or public-health restrictions;
  • Government actions, orders, or restrictions;
  • Strikes or major labour disruptions;
  • Transport or logistics failures outside our reasonable control;
  • Internet, telecommunications, or electricity failures;
  • Payment-network outages;
  • Civil unrest or similar emergencies; or
  • Other events that could not reasonably have been prevented or controlled by us.

If such an event materially affects an Order or Subscription, we will take reasonable steps to communicate available options where practicable.

32. Consumer Rights

Nothing in these Terms is intended to exclude, restrict, waive, or override any mandatory rights or remedies available to consumers under applicable Indian law.

If any provision of these Terms conflicts with a mandatory consumer protection requirement, the mandatory legal requirement will apply to the extent of the conflict.

33. Governing Law

These Terms and your use of the Service shall be governed by and interpreted in accordance with the laws of India, without prejudice to any mandatory consumer rights available under applicable law.

34. Dispute Resolution and Jurisdiction

If you have a concern or dispute relating to an Order, Subscription, account, Product, or the Service, we encourage you to contact us first so that we can attempt to resolve the matter.

Subject to applicable law and any statutory consumer forum or authority having jurisdiction, disputes arising out of or relating to these Terms or the Service shall be subject to the jurisdiction of the competent courts in Patna, Bihar, India.

Nothing in this section prevents a consumer from approaching any consumer commission, regulator, authority, or other forum available to them under applicable law.

35. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our Products, Applications, business practices, Subscription arrangements, technology, legal requirements, or Service features.

When we make changes, we will update the "Last updated" date appearing at the beginning of these Terms.

Where required by applicable law or where a change materially affects your rights, we may provide additional notice through the Website, Application, account, email, or another appropriate communication method.

Your continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

36. Entire Agreement

These Terms, together with our Privacy Policy, Refund and Returns Policy, and any additional terms expressly applicable to a particular offer, Product, or Subscription, constitute the applicable agreement between you and Native Nature regarding your use of the Service.

If separate terms relating to a particular promotion, Subscription, or service conflict with these general Terms, the specific terms will apply to that matter to the extent of the conflict.

37. Severability

If any provision of these Terms is found by a competent authority to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect to the extent permitted by law.

38. No Waiver

If Native Nature does not immediately enforce a provision of these Terms, this does not mean that we waive the right to enforce that provision later.

A waiver of one breach will not automatically constitute a waiver of any subsequent breach.

39. Assignment

You may not transfer or assign your rights or obligations under these Terms to another person without our prior written consent where such consent is required.

Native Nature may transfer its rights or obligations in connection with a lawful corporate restructuring, merger, acquisition, business transfer, or similar transaction, subject to applicable law and without reducing mandatory consumer protections.
